The Site is operated by SKINGRAPHICA PTY LTD (ACN 684 257 261, ABN 54 684 257 261). Our registered office is The Trust Building, Suite 703, Level 7, 155 King Street, Sydney NSW 2000, Australia.

We aim to reply to every message within 2 business days (Sydney time).

By using the Site you agree to these Terms. When you place an order, create an account or join one of our programs we will ask you to confirm that you accept them. If you do not agree, please do not use the Site.

Some programs have their own rules or written agreements. Where they apply, clause 23 explains how they fit with these Terms.

We may provide translated versions of these Terms for convenience. If there is any inconsistency, the English version applies to the extent the law allows.

You must be at least 18 years old to buy from the Site, create an account or take part in any of our programs. Anyone may browse the Site and read our editorial content.

Our products are sold for personal use. We may decline an order that we reasonably believe is intended for unauthorised resale. If we do, we will tell you and refund any amount you have paid in full. SKINGRAPHICA products are sold only through the Site and through retailers and studios we have authorised. If you buy from anyone else we cannot verify the product, its storage or its authenticity, although any rights you have against that seller under the law are not affected.

You can create a customer account to view orders, manage your details and use some features of the Site. Please give accurate information and keep it up to date. Keep your login details secure and tell us promptly at concierge@skingraphica.com if you think someone has used your account without permission.

You can close your account at any time by contacting us. We may suspend or close an account if we reasonably believe it is being used fraudulently or unlawfully or in serious breach of these Terms. Unless the law or a security risk prevents it, we will tell you why and give you a reasonable opportunity to respond before we do so. Closing an account does not affect orders already placed, refunds owed to you or your rights under consumer law.

SKINGRAPHICA products are cosmetics. The range is built around 4 stages. PRIME (Stage 01 Prepare) is used before a tattoo appointment. LOCK (Stage 02 Recover) is used on a new tattoo while it heals. SHIELD (Stage 03 Protect) is a daily SPF15 for healed tattoos. LUME (Stage 04 Restore) refreshes the look of faded ink and does not add pigment. We also offer the SYSTEM, SYSTEM PLUS and SYSTEM LUX kits.

We take care to describe and photograph our products accurately. Colours and textures can look different on different screens and packaging may be updated from time to time. The ingredient list and directions on the product you receive are the ones that apply to that product. Please read them before use.

If we discover an error in product information we will correct it as soon as we reasonably can. If an error affects an order you have placed, we will contact you and you may cancel that order for a full refund.

Prices are shown in the currency displayed on the Site. For Australian customers prices include GST. For customers in the European Union and the United Kingdom prices include VAT. For customers in other countries prices do not include local tax, and the GST or sales tax that applies in your country is calculated by Zonos and shown at checkout before you pay, as explained in clause 9. The total shown at checkout is the total you pay.

We accept the payment methods shown at checkout. These may include cards and digital wallets processed through Shopify Payments and, where offered, Afterpay and Klarna. If you use a buy now pay later service, your agreement with that provider governs your repayments. Payment is taken when you place your order.

Promotional codes and offers are subject to the conditions shown with them. Unless those conditions say otherwise, only 1 code can be used per order and codes cannot be exchanged for cash.

If a product is listed at a price that is obviously wrong, we will not supply it at that price without your agreement. We will contact you and you can choose to proceed at the correct price or cancel and receive a full refund. We will never charge you more than the price you accepted at checkout without your express agreement.

Placing an order is an offer to buy the products in your cart. We will email you to confirm that we have received your order. Your contract with us is formed when we accept your order by sending you an email confirming that it has been dispatched.

We may decline an order before dispatch only for a genuine reason, such as a product being unavailable, a pricing error, a delivery address we cannot serve, suspected fraud or suspected unauthorised resale. If we do, we will tell you and refund everything you have paid within 5 business days.

If you want to cancel an order before it is dispatched, email concierge@skingraphica.com with your order number as soon as possible. If the order has not yet been dispatched we will cancel it and refund you in full. Once an order is dispatched, the returns and withdrawal rights in clauses 12 to 14 apply.

Our products are made in Australia and shipped worldwide from Australia by FedEx International. Delivery options, costs and estimated timeframes are shown at checkout. Estimates are given in good faith but can be affected by customs clearance and carrier networks.

We deliver to the countries listed at checkout. We do not currently deliver to Italy or Spain. If you live in a country we do not deliver to, including Italy or Spain, you can still buy from the Site on the same terms as other customers for delivery to an address in a country we do deliver to.

Responsibility for the products passes to you when they are delivered to you or to a person you nominate, other than the carrier. Ownership passes to you on delivery, provided we have received payment.

If your order has not arrived within the estimated timeframe, please contact us. If a parcel is lost or damaged in transit, we will send a replacement or give you a full refund. If we fail to deliver within the timeframe agreed or, where none was agreed, within 30 days after your order, you may cancel and receive a full refund, in addition to any other rights you have under the law.

Please check your delivery address carefully. If a parcel is returned to us because the address you gave was incorrect or incomplete, we will contact you to arrange redelivery. We may ask you to pay the reasonable cost of resending it.

For international orders we use Zonos to calculate and collect import duties and taxes at checkout on a Delivery Duties Paid basis. The total you see at checkout is the total you pay. You should not be asked by the carrier to pay further import duties, taxes or customs fees on delivery.

At the date of these Terms we absorb United States tariffs and the customs duties and import fees for every country we deliver to. For the European Union and the United Kingdom the VAT is included in the price and settled by us. For other countries Zonos calculates and collects the GST or sales tax that applies in your country at checkout. These arrangements may change for future orders, but the total shown at checkout will always be the amount that applies to your order.

If a carrier or customs authority asks you for any further payment on an order shipped on this basis, please contact concierge@skingraphica.com before paying. We will resolve it with the carrier or reimburse you for any amount you are properly required to pay.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These guarantees include that our products are of acceptable quality, match their description and are fit for any purpose we tell you they are suitable for. They apply whether or not you have opened the product and are in addition to any voluntary returns policy in these Terms.

To make a claim, email concierge@skingraphica.com with your order number, a description of the problem and photos if you can. If a product does not meet a consumer guarantee, we will pay the reasonable cost of returning it. We will not refuse a valid claim because you no longer have the original packaging or because the product has been opened or used as directed.

If you experience a skin reaction, stop using the product and seek medical advice where needed, then let us know. A reaction does not of itself mean a product is faulty, but we take every report seriously and will work through it with you in line with the law.

If you live outside Australia you have the consumer rights given by the laws of your country. For example, consumers in the European Union have a legal guarantee that goods conform to the contract for at least 2 years from delivery, and consumers in the United Kingdom have rights under the Consumer Rights Act 2015, including the short term right to reject faulty goods within 30 days. Consumers in the United States and Canada have the warranties and protections implied by their state, provincial or federal laws to the extent they cannot be excluded.

We honour these rights. To make a claim, contact concierge@skingraphica.com. We will not ask you to give up any right that the law of your country does not allow us to exclude.

There are 3 separate ways to return a product to us.

1. Faulty or incorrect products. Your rights under clauses 10 and 11 apply whether or not the product has been opened.
2. Change of mind. Our voluntary policy in clause 13 lets you return unopened products with the hygiene seal intact within 30 days of delivery.
3. EU and UK withdrawal. If you are a consumer in the European Union or the United Kingdom, you also have the statutory right to withdraw explained in clause 14 and in our EU and UK Right of Withdrawal notice.

If more than 1 of these applies, you can rely on whichever gives you the better outcome. We refund to the original payment method unless you agree otherwise, and we do not charge any fee for a refund.

In addition to your rights under the law, you may return a product because you have changed your mind if all of the following apply.

• You contact concierge@skingraphica.com within 30 days after delivery and tell us which products you wish to return. We will reply with a return authorisation and a prepaid return label.
• The product is unopened, the hygiene seal is intact and it is in a condition in which we can resell it.
• You send the product back within 14 days after we give you the return authorisation.

We ask you to keep the hygiene seal intact because our products are applied to skin, including newly tattooed skin. Once a seal is broken we cannot resell the product safely.

We provide the prepaid return label at no cost to you. The original delivery charge is not refunded for change of mind returns. We will refund the price you paid for the returned product, including any GST or VAT you paid on it, within 14 days after we receive it.

This clause does not limit your rights for faulty products or your statutory right to withdraw in the European Union or the United Kingdom. Those rights are more generous in some respects. For example, an EU or UK withdrawal includes a refund of the standard delivery charge.

If you are a consumer habitually resident in the European Union or the United Kingdom, you may withdraw from your contract within 14 days after the day you, or a person you nominate other than the carrier, receive the products, without giving any reason.

You can withdraw using the Withdraw from contract here function on our EU and UK Right of Withdrawal page, which is also linked from your order confirmation email and your account, by email to concierge@skingraphica.com or by any other clear statement.

The right of withdrawal does not apply to a sealed product that is not suitable for return for health protection or hygiene reasons if you have unsealed it after delivery. It continues to apply to any product whose seal remains intact.

Full details, including the effects of withdrawal, return costs and a model withdrawal form, are set out in our EU and UK Right of Withdrawal notice. That notice prevails over any other part of these Terms for EU and UK consumers.

Our digital gift cards are delivered by email. They are sold in set amounts, priced in the currency of your market, and each card is issued in the currency you pay in. You can send a gift card to yourself or straight to someone else on a date you choose, up to 90 days ahead.

A gift card can be redeemed on the Site towards the purchase of products. It cannot be exchanged for cash except where the law requires. We do not charge any fee after a gift card is purchased.

Our gift cards do not expire.

Please treat a gift card code like cash. If a code is lost or stolen, contact us and we will cancel and reissue the unused balance where we can verify the purchase.

If you are a consumer in the European Union or the United Kingdom, you may cancel the purchase of an unused gift card within 14 days of buying it for a full refund.

Our products are for external use on skin only. Before using any product, please read the full label, including the ingredient list, directions and warnings.

• Patch test. Patch test each product before first use, following the directions on the pack. If no directions are given, apply a small amount to a small area of healthy skin and wait at least 24 hours before wider use.
• Allergies and sensitivities. Check the ingredient list if you have any known allergy or sensitivity. If you are unsure whether a product is suitable for you, speak to a doctor or pharmacist before use.
• Stop use if you react. Stop using a product immediately if you notice irritation, redness, swelling, itching or any other reaction, and seek medical advice if it does not settle.
• New tattoos. Always follow the aftercare guidance of your tattoo artist. Use LOCK only as directed on its pack. Seek medical attention promptly if you see signs of possible infection, such as increasing redness, swelling, heat or pain, pus or fever.
• Healed tattoos. SHIELD and LUME are for healed tattoos and healthy skin only.
• General care. Avoid contact with eyes. Keep out of reach of children. Store as directed on the pack. Do not use a product after its expiry date or period after opening. If you are pregnant or breastfeeding, have a skin condition or are under medical care, ask your doctor before use.

SHIELD is a daily SPF15 for healed tattoos, formulated with organic filters. It is designed to form part of your everyday sun care routine.

SHIELD is not a substitute for a broad spectrum SPF50+ sunscreen on long days outdoors or when you expect high or prolonged sun exposure. On those days use an SPF50+ sunscreen and reapply it as directed. Also seek shade and wear protective clothing, a hat and sunglasses. No sunscreen provides complete protection. Follow the directions on the pack, including how much to apply and when to reapply.

Our concierge service, care guides, Academy articles, ICONICA magazine, product instructions, care planner reminders and Ink-Profiler™ suggestions provide general information about caring for tattooed skin and about our products. They are not medical, dermatological or other professional advice and do not take the place of advice from your doctor or your tattoo artist.

The care planner sends you stage by stage reminders based on the appointment date you give us. The reminders are a convenience. Please follow the timing your tattoo artist recommends if it differs.

The Ink-Profiler™ tool suggests products based on your answers about your skin and tattoos. Its suggestions are generated from your answers and are not a diagnosis or an assessment of any medical condition. Answering is optional and how we handle your answers is explained in our Privacy Policy.

If you have a concern about your skin or your tattoo, or any sign of infection or reaction, please consult a doctor promptly. Do not delay seeking medical help because of anything you read on the Site.

We publish customer reviews through our reviews provider, Okendo. Reviews must reflect your own genuine experience of the product. If you received anything in return for a review, such as a free product or a discount, you must say so in the review.

We publish positive and negative reviews alike. We do not edit the meaning of a review. We may decline to publish, or remove, a review or other content you post if it is unlawful, misleading, fake, offensive, defamatory, off topic or promotional, if it contains another person’s personal information, or if it makes medical or therapeutic claims. When we remove your content we will tell you why, unless the law prevents us.

By posting a review, photo or comment on the Site you grant us a nonexclusive, worldwide, royalty free licence to host, reproduce, display and share it on the Site, on our social media channels and in our marketing, with your display name. You can ask us to remove your review at any time and we will do so within a reasonable time.

If you believe any content on the Site is unlawful or infringes your rights, please report it to policies@skingraphica.com with the location of the content and the reasons. We will review the report promptly, act on it where appropriate and tell you the outcome.

STATUS is our rewards program for collectors who submit photos of their tattoos. Membership tiers, benefits and eligibility are set out in the STATUS program rules, which apply in addition to these Terms. Members inducted into the Hall of Fame receive the benefits described in those rules, including a lifetime 10% discount, a complimentary photo shoot and a photo book. Lifetime means for as long as the member’s account remains open and the STATUS program operates.

When you submit a photo you confirm that

• it is a genuine, unaltered photograph of a tattoo on your own skin, or you have the permission of the person shown
• you have the right to share it with us and to grant the licence in clause 21
• any artist or studio details you give us are accurate to the best of your knowledge.

We review submissions before accepting them. Our review may use automated tools to help detect images that are generated or altered by artificial intelligence, and we may ask the tattoo artist to confirm the work. A person on our team makes the final decision on every submission. We may decline a submission that does not meet the program rules and we will tell you why.

We may change or close the STATUS program for good reason, such as a change in law or in our business. We will give members at least 30 days’ notice of any change that reduces their benefits, and benefits already earned will be honoured or fairly replaced.

Your tattoo remains your own and the design remains the work of your artist. When you submit a photo to STATUS, the Hall of Fame or any of our programs, you grant us a nonexclusive, worldwide, royalty free licence to use, reproduce, adapt for format (for example cropping or resizing), publish, display and communicate that photo in connection with the program, the Hall of Fame, the Site, our social media channels, our marketing and our archive.

We will credit the tattoo artist and studio wherever practical and the details are known to us. We will not alter a photo in a way that misrepresents the work or the artist.

You can ask us at any time to stop using a photo. We will remove it from the Site and stop new uses within 30 days. We will not be required to withdraw printed materials already produced or to delete posts that cannot reasonably be edited, but we will not use the photo again.

If you are a tattoo artist and see your work on the Site without correct credit, or you object to its use, contact policies@skingraphica.com and we will correct the credit or remove the image promptly.

We publish the SKINGRAPHICA Global Artist Rankings each year. They comprise Black Ivy (Global Top 10), GRAPHICA (Global Top 100) and NOVA (Global Rising 20). Artists are assessed by anonymous inspectors against criteria we publish on the Site.

The rankings are our editorial opinion. Places in the rankings are never for sale and are not influenced by any purchase, payment, advertising or commercial relationship. Inclusion in, or absence from, the rankings is not a statement about the quality of any individual tattoo, and you should choose any artist using your own judgement.

Each ranked artist has a public profile that may show their name, studio, city, styles, Instagram handle and the citation we have written. Ranked artists may ask us to update or correct factual details in their profile at policies@skingraphica.com. We will correct factual errors promptly. Citations and rankings are editorial judgements and we may decline to change them, but we will consider every request in good faith and respond with reasons.

Ranked artists may use the name of their ranking and any badge we provide in line with the brand guidelines we supply. They must not suggest that SKINGRAPHICA endorses anything other than their place in the rankings.

Rankings lists. The published rankings lists, meaning the ranked artist names, ranks, studios and cities as they appear in each list, are licensed under the Creative Commons Attribution NoDerivatives 4.0 International licence (CC BY-ND 4.0). You may share them in any medium for any purpose, provided you credit “SKINGRAPHICA Global Artist Rankings” with the year and a link to skingraphica.com, indicate if you have made changes and do not distribute modified versions. The licence does not grant any right to use our trade marks or the personal rights of any artist, and it does not suggest that we endorse you or your use.

Editorial content. All other content in the rankings, including citations, inspector reports, photography, design and articles, is our copyright and all rights are reserved.

Featured Artists and ICONICA. Featured Artist stories are by invitation and open to ranked artists only. Each feature is covered by a separate agreement with the artist. We pay for the photography we commission and we own the copyright in that photography. Artists keep the copyright in their own tattoo designs.

GRAPHICA Program, Studio Partner Program and Signature Studios. These programs are for tattoo artists and studios. Signature Studios are independently assessed and recognition is never for sale. Each program has its own rules and, where relevant, a written agreement. If those rules or that agreement are inconsistent with these Terms, the program rules or agreement prevail to the extent of the inconsistency, except that they cannot remove any right you have under consumer law.

We may change or close a program for good reason. We will give participants reasonable notice, and at least 30 days’ notice of any change that materially reduces their benefits.

Artists and studios in the GRAPHICA Program and the Studio Partner Program can share in revenue from clients they refer to us. The commission rate, eligible sales, tracking method, payment timing and other details are set out in the program rules or your written agreement.

At a high level, the following applies.

• Commission is earned only on eligible sales correctly tracked to you under the program rules.
• Commission is not payable on orders that are cancelled, refunded or returned, or that we reasonably believe are fraudulent. Where commission has already been paid on such an order, we may deduct it from future payments.
• You are responsible for your own tax obligations, including any GST or other registration, and for giving us accurate payment and tax details.
• When you promote SKINGRAPHICA you must clearly disclose your commercial relationship with us, for example with a label such as “ad” or “paid partnership”, in line with the advertising rules that apply where you and your audience are located.
• You must not make medical or therapeutic claims about our products, make any other misleading claim or send unsolicited marketing messages.

On request, we may provide a ranked artist with a letter confirming factual information about their ranking, such as the ranking, the year and the published criteria. Letters are provided free of charge, at our discretion and only where we can verify the information.

We do not provide immigration, migration or legal advice. A letter from us does not guarantee that any visa, permit or application will be granted, and we have no role in any government decision. Each letter is accurate as at the date it is issued. Please obtain advice from a registered migration agent or a qualified immigration lawyer about your application.

The Site and its content, including text, images, video, design, product names and the Ink-Sights™ research, are owned by us or our licensors and protected by copyright and other laws. SKINGRAPHICA is a registered trade mark and Ink-Safe™ and Ink-Sights™ are our trade marks.

You may view, download and print pages for your own personal, non commercial use. Except as these Terms allow, including the rankings licence in clause 23, you may not copy, adapt, distribute or commercially use any content from the Site without our written permission. Nothing in these Terms limits any use permitted by law, such as fair dealing for criticism, review or news reporting.

When using the Site you must not

• break any law or infringe anyone’s rights, including their privacy or intellectual property
• post or submit anything that is false, misleading, defamatory, obscene, hateful or harassing
• impersonate any person or misrepresent your connection with any person, artist or studio
• interfere with the security or operation of the Site, introduce malicious code or try to gain unauthorised access to any account or system
• use automated means to scrape or collect content or data from the Site, or use Site content to train artificial intelligence models, without our written permission
• manipulate reviews, submissions, referrals or the rankings, or offer any inducement to influence them
• use the Site to send spam or other unsolicited communications.

If you breach this clause we may remove your content and, as explained in clause 4, suspend or close your account.

Some parts of the Site are provided by third parties, including Shopify, payment and buy now pay later providers, Zonos, FedEx, Okendo and Calendly. Their own terms and privacy policies may also apply when you use their services.

The Site contains links to other websites and social media platforms. We do not control them and are not responsible for their content or practices, except to the extent the law makes us responsible.

If we fail to comply with these Terms or act negligently, we are responsible for loss or damage you suffer that is a reasonably foreseeable result of our failure. Loss or damage is foreseeable if it was an obvious consequence of our failure or if it was contemplated by you and us when the contract was made. We are not responsible for loss or damage that is not foreseeable.

If you are a consumer, we supply our products for personal and domestic use only. To the extent the law allows, we are not responsible to a consumer for loss of business, profit or opportunity.

If you buy products for business purposes and are not a consumer under the Australian Consumer Law or the law of your country, our total liability to you in connection with an order is limited to the price paid for that order, to the extent the law allows.

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, pandemics, industrial action, carrier or customs disruption or failures of third party networks. If such an event affects your order, we will tell you promptly and you may cancel for a full refund.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, under the consumer guarantees in the Australian Consumer Law, under product liability laws or for anything else that cannot lawfully be excluded or limited.

This clause applies only to artists, studios and other businesses taking part in our programs in the course of their business. It does not apply to consumers.

If you are a business participant, you agree to compensate us for loss, damage and reasonable costs we incur because of a claim by a third party arising from content you supply to us that infringes that third party’s rights, or from your serious or deliberate breach of the program rules. The amount you must pay is reduced to the extent that the loss was caused or contributed to by us. We will tell you promptly about any such claim, act reasonably to reduce the loss and not settle it without consulting you.

We handle personal information in line with our Privacy Policy, which explains what we collect, how we use and share it, the choices you have and how to contact us. Please read it together with these Terms.

We may update these Terms from time to time to reflect changes in the law, in our products, programs or services or in how we operate. We will publish the updated Terms on the Site with a new date.

If a change is material and may affect you adversely, we will give account holders and program participants at least 14 days’ notice by email before it takes effect, unless the change is required sooner by law. A change never applies to an order placed before the change took effect. If you do not agree with a change, you can stop using the Site and close your account before the change takes effect.

These Terms are governed by the law of New South Wales, Australia. The courts of New South Wales and the courts entitled to hear appeals from them have non exclusive jurisdiction.

If you are a consumer living outside Australia, choosing New South Wales law does not take away the protection of the mandatory consumer laws of the country where you live. You may bring proceedings in the courts of your home country where those laws allow.

If something has gone wrong, please contact concierge@skingraphica.com first. We will acknowledge your complaint within 2 business days and aim to resolve it within 30 days.

If we cannot resolve your complaint, you may contact the consumer protection agency where you live. In Australia this is the ACCC or your state or territory fair trading agency, such as NSW Fair Trading. Consumers in the European Union can contact the European Consumer Centre in their country. Nothing in this clause limits your right to go to court or to any tribunal that can hear your claim.

• If any part of these Terms is found to be unenforceable, the rest of the Terms continue to apply.
• If we do not enforce a right straight away, we can still enforce it later.
• We may transfer our rights and obligations under these Terms to a related company or to a buyer of our business. We will tell you if this happens and it will not reduce your rights. You may not transfer your rights under these Terms without our consent, which we will not unreasonably refuse.
• These Terms, together with the documents referred to in them and any program rules or written agreement that applies to you, are the whole agreement between you and us about their subject matter.
